Article 1 – Purpose
These General Terms and Conditions of Sale govern the contractual relationship between Agathe Liauzun / Ataraxia (hereinafter "the Seller") and any buyer (hereinafter "the Customer") placing an order on the website ataraxiacrea.com. Any order placed on the website implies the full and unreserved acceptance of these GTC by the customer.
Article 2 – Products
The products offered for sale are original works of art/unique handcrafted creations which are described and presented with the greatest possible accuracy. Each piece is handmade by the artist. Photographs of the works are as faithful as possible, but slight variations in color may exist depending on the screen.
Article 3 – Price
Prices are indicated in euros (€), all taxes included. Pursuant to Article 293 B of the General Tax Code, VAT is not applicable. The Seller reserves the right to change its prices at any time, it being understood that the price applicable is the one in force at the time of the order.
Article 4 – Ordering
The customer selects the products they wish to order and adds them to their cart. Before finalizing the order, the customer can check the contents of their cart, the total price, and delivery fees, and correct any errors. The order is validated and becomes final upon confirmation of payment. The Customer will receive a confirmation email summarizing their order. The Seller reserves the right to cancel any order in the event of stock or payment issues.
Article 5 – Payment
Payment is made online, securely, via the methods offered on the site. The order will only be processed upon receipt of full payment.
Article 6 – Availability
Products are offered within the limits of available stocks.
In the event of a product's unavailability after the order has been placed, the customer will be informed as soon as possible and will be able to obtain a refund for the product in question.
Creations indicated as being available on request or for pre-order may be subject to a specific manufacturing lead time, indicated on the product sheet or before order validation.
Article 7 – Delivery
Orders are shipped within 7 days after payment confirmation to the address provided by the customer at the time of ordering. Estimated delivery costs and times are indicated at the time of the order.
In the event of an exceptional delay, the customer will be informed as soon as possible. The Seller cannot be held responsible for delays attributable to the carrier.
The customer is invited to check the condition of the package upon receipt. In the event of a visibly damaged package, it is recommended to immediately report the necessary reservations to the carrier and to contact Ataraxia.
Article 8 – Right of withdrawal
In accordance with Article L221-18 of the Consumer Code, the Customer has a period of 14 days from receipt of their order to exercise their right of withdrawal by contacting the Seller at ataraxiacrea@outlook.fr. Returns are subject to the conditions detailed in the return and refund policy.
Article 9 – Products excluded from the right of withdrawal
In accordance with Article L.221-28 of the Consumer Code, certain products may be excluded from the right of withdrawal, particularly when they are made according to the consumer's specifications or are clearly personalized.
This exclusion only applies to products effectively meeting the conditions provided for by law.
Standard products available on the site remain subject to the right of withdrawal when no legal exception is applicable to them.
For original works and handcrafted creations, the right of withdrawal is therefore determined according to the exact nature of the order and, in particular, the existence or absence of personalization requested by the customer.
Article 10 – Returns and refunds
Any return must be made in accordance with the procedures communicated by Ataraxia.
The returned product must be correctly protected in order to avoid any deterioration during transport.
The customer may be held liable for any depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the product.
Original works must in particular be returned with packaging allowing for their protection during transport.
Article 11 – Intellectual property
All elements present on the site, including photographs, illustrations, paintings, creations, texts, logos, graphics, and visuals, are protected by intellectual property provisions. They remain the intellectual property of Agathe Liauzun.
The purchase of a work or reproduction does not entail any transfer of the intellectual property rights attached to the work.
Any reproduction, representation, modification, adaptation, or use, in whole or in part, of Ataraxia's creations without prior authorization is prohibited.
Article 12 – Legal warranties
The products sold are covered by the applicable legal warranties, in particular:
- the legal warranty of conformity;
- the legal warranty against hidden defects.
These warranties apply independently of any potential commercial warranty.
In the event of a defective or non-compliant product, the customer is invited to contact Ataraxiacrea at the address ataraxiacrea@outlook.fr describing the problem encountered and, if necessary, attaching photographs allowing the defect to be observed.
Article 13 – Liability
Ataraxia cannot be held liable for damage resulting from misuse or improper maintenance of the product by the customer.
For handcrafted items, the customer is invited to follow any maintenance and storage recommendations indicated on the product sheet or communicated with the order.
Ataraxia's liability cannot be engaged in the event of force majeure or an event beyond its control preventing or delaying the execution of the order.

Article 15 – Applicable law and disputes
These GTC are subject to French law.
In the event of a dispute, the consumer is invited to seek an amicable solution with Ataraxia first.
Failing an amicable agreement, the consumer may exercise the remedies provided for by applicable regulations.
Article 16 – Modification of the GTC
Ataraxia reserves the right to modify these GTC at any time.
The GTC applicable to an order are those accepted by the customer at the time of validation of said order.
Article 17 – Personal data
The data collected during the order is used solely for the purpose of processing it. In accordance with the GDPR, the Customer has a right of access, rectification, and deletion by contacting: ataraxiacrea@outlook.fr
